About ISO/IEC 37001
ISO 37001 is a tool for building or improving anti-corruption management systems. It can also be used to evaluate the company's existing measures and compare their level with the so-called "best practice". Although the standard does not provide absolute protection against corruption, it helps to prevent it and also address it. In the event that allegations of bribery are made, the standard is proof that the company has taken the necessary steps to manage the risks associated with corruption, and certification can thus be a mitigating circumstance.
The ISO 37001 standard is designed so that it can be introduced into its management system by companies of any size, legal form, industry or location. Similarly, the standard may be applied only to a specific part of an organization or group of activities.
ISO 37001 is part of the standards issued by the International Organization for Standardization, abbreviated ISO.
Some other standards also apply to ISO 37001, such as ISO 19600 - Compliance management systems, ISO 26000 - Corporate social responsibility, ISO 31000 - Risk management. These standards are for guidance only, while ISO 37001 imposes precise requirements that a company must meet in order to get certified.
ISO 37001 was developed by the ISO / PC 278 ISO project committee, Anti-bribery management systems, under the leadership of the International Chamber of Commerce, the Organization for Economic Co-operation and Development (OECD), Transparency International and several governments that have agreed on best practices in the fight against corruption.
Legislative framework of ISO 37001
The new anti-corruption standard is not yet enshrined in Czech legislation. However, the amendment to Act No. 418/2011 Coll., on the Criminal Liability of Legal Entities and Proceedings Against Them, came into effect on 1 December 2016 and brought the option of release from liability provided that the company “made every effort that could be fairly demanded of it " to prevent the commission of a criminal offense. For this reason, the introduction of the most effective anti-corruption measures is an important and effective step.
Často kladené otázky o certifikaci ISO 37001
Je potřeba, abychom zavedli nový systém protikorupčního managementu, pokud chceme získat certifikaci ISO 37001?
Není nutné, abyste budovali zcela nový systém. Stačí, když nová opatření zavedete do již existujících procesů. Norma ISO 37001 byla navržená v souladu se strukturou ISO standardů pro systémy managementu, což usnadňuje její integrraci například s ISO 9001 – Systém managementu kvality nebo s ISO 19600 – Systémy managementu compliance.
Je přijetí normy ISO 37001 povinné?
Obecně platí, že ne. Záleží na rozhodnutí každé organizace. Nicméně se může stát, že standard bude mandatorním požadavkem ze strany dodavatelů či v případě některých veřejných zakázek.
Musí být standard aplikován na celou organizaci?
Nemusí. Je možné ho použít pouze v rámci části vaší organizace, na konkrétní procesy a aktivity.
